Three States Update Their Direct-to-Consumer Shipping Laws

Mississippi, Arkansas, and Delaware each enacted direct-to-consumer wine shipping legislation in 2025. Mississippi offers the most accessible entry point, while Arkansas and Delaware still present operational challenges.


Mississippi now allows domestic wine producers to ship up to 12 cases annually per household, requiring ABC licensing, sales tax collection, and a 15.5% markup. Arkansas removed its in-person purchase requirement, expanding limits to 24 cases per person annually. Compliance remains complex due to dry/wet township restrictions requiring address verification against state maps.


Delaware's new law still presents significant barriers with $3,600 licensing fees, 1,800 annual case limits, and prohibitions against wineries with existing wholesale relationships. Major carriers have even declined to service Delaware shipments.
