Virginia Governor Glenn Youngkin signed a bill into law requiring distributors to ensure that alcoholic and non-alcoholic products with similar branding aren't shelved immediately adjacent to each other at off-premise retailers. The law also requires that alcoholic products from soft drink companies are accompanied by clear signage indicating their alcohol content.
The bill was passed with virtually unanimous bipartisan support in order to address widespread concerns raised over consumer confusion and competitive advantage. Other states are also moving to regulate this new phenomenon with a similar measure in Illinois also advancing to prevent side-by-side placement.
In Virginia and Nevada, beer wholesalers have also complained to state regulators about the distribution model for Hard Mtn Dew. The product is distributed by a PepsiCo subsidiary, Blue Cloud Distribution. [Pluribus News]
